By using Call Earl's services, you ("the business owner") agree to these Terms and Conditions. Please read them carefully.


Our Services

Call Earl provides AI-powered SMS reception and communication services for home service businesses, including:

- Responding to inbound customer text messages and calls

- Booking and confirming service appointments

- Sending appointment reminders to customers

- Requesting Google reviews following completed jobs


Subscribing businesses receive a dedicated phone number through which their customers may text to interact with Earl.

Subscriptions and Billing

Services are provided on a monthly subscription basis. Billing is

processed securely via Stripe. Subscriptions renew automatically

each month and may be cancelled at any time with 30 days notice.

No refunds are issued for partial months.

Business Owner Responsibilities

By subscribing to Call Earl, you agree to:

- Provide accurate business information including hours, services, and availability

- Ensure your customers have a reasonable expectation of receiving automated SMS messages when contacting your business

- Comply with all applicable laws regarding customer communication and data privacy

- Not use Call Earl for unlawful, harmful, or deceptive purposes

SMS Compliance

Call Earl operates in compliance with TCPA regulations and Twilio's Acceptable Use Policy. All SMS campaigns are registered through the A2P 10DLC system. End-users may opt out of messages at any time by replying STOP. Business owners are responsible for ensuring their customers' consent to receive automated messages.


AI-Generated Responses

Call Earl's responses are generated by an AI model. While we work to ensure responses are accurate and appropriate, we cannot guarantee that every AI-generated response will be error-free. Business owners should monitor their Earl conversations periodically and contact us at hello@callearl.co if they identify any issues.


Limitation of Liability

Call Earl is not liable for missed appointments, lost business revenue, or damages arising from:

- Service interruptions or downtime

- Inaccurate AI-generated responses

- Delays in message delivery via third-party carriers

- Actions or inactions of end-users


Our total liability in any circumstance is limited to the amount you paid us in the 30 days prior to the claim.

Termination

We reserve the right to suspend or terminate service to any business owner who violates these terms, misuses the platform, or engages in conduct harmful to end-users or our reputation.


Changes to Terms

We may update these terms at any time. We will notify subscribing business owners of material changes via email. Continued use of our services after notification constitutes acceptance of updated terms.

Governing Law

These terms are governed by the laws of the State of Texas.
